Judge to rule on SE St Mary injunction issue
published: Thursday | September 27, 2007

Senior Puisne Judge Marva McIntosh will rule today on the legal point taken on Tuesday by lawyers representing People's National Party candidate Harry Douglas for the St. Mary South Eastern constituency.

The lawyers are saying that Jamaica Labour Party candidate Tarn Peralto cannot get an injunction against the Crown and officers of the Crown.

Seeking an injunction

Peralto, who was declared the winner, is seeking an injunction to bar Director of Elections Danville Walker from counting the ballots in two boxes for the constituency.

Attorney-at-law Paul Beswick, who is representing Peralto, agreed that an injunction could not be granted against the Crown, but he went on further to argue that an injunction could be granted against officers of the Crown.
