The case in which the foreman of the jury handed down the wrong verdict on March 12 has been referred to the Court of Appeal.Justice Almarie Sinclair Haynes yesterday 'arrested' the verdict when 35-year-old Kevin Bryan came before her for sentencing.
The judge offered Bryan bail in the sum of $80,000 with sureties.
In handing down the verdict in a carnal abuse case in the Home Circuit Court, the foreman had said "guilty" instead of "not guilty".
Remanded for sentencing
The mistake resulted in 35-year-old Kevin Bryan, who was represented by attorney-at-law Tamika Harris, being remanded until yesterday for sentencing.
It was after the jurors had left the courtroom and court had adjourned that some of them told court officials that the foreman had made a mistake. The judge was informed and, when she went back into court, the jurors told her of the mistake.
The judge, in referring the case to the Court of Appeal, said she had the authority to do so under the Criminal Justice Administration Act, as well as a 2004 English case.
